外籍人士与妻子失去联系7年，法院裁决……
根据深圳市龙华区人民法院3月6日的消息，涉及港澳台及外因素的深圳家庭审判中心已审结了一起涉外离婚纠纷案。
It is understood that in this case, Ms. Wang and Mr. Fujita were married in 2005 and have a son. After the marriage, Mr. Fujita returned to Japan in 2016 due to business failure and mental pressure. Since then, Mr. Fujita has not contacted Ms. Wang and the child. In 2017, Ms. Wang attempted to contact Mr. Fujita while she was ill and hospitalized, but was unable to contact him.
据悉，在这起案件中，王女士与藤田先生于2005年结婚，并育有一子。婚后，藤田先生因事业失败和心理压力于2016年返回日本。自那时起，藤田先生便未再与王女士和孩子联系。在2017年，王女士生病住院期间试图联系藤田先生，但未能联系上。
According to the entry and exit records, Mr. Fujita has not been to China since 2016 and has been separated from Ms. Wang for more than seven years. Now that the child is about to turn 18 years old, in order to start a new life, Ms. Wang filed a lawsuit with the Shenzhen Family Trial Center Involving Hong Kong-Macao-Taiwan and Foreign Factors, requesting the court to divorce the plaintiff and defendant.
根据出入境记录显示，藤田先生自2016年以来未曾回到中国，与王女士分离超过七年。现在孩子即将满18岁，为了开始新生活，王女士向涉港澳台及外因素的深圳家庭审判中心提起诉讼，请求法院判决原告与被告离婚。
After the trial, the court ruled that marital relationships should be based on emotions and couples should care for and help each other in their daily lives. An important part of marital life is living together, and although the two parties in this case have been married for many years, they have been separated for 7 years after their marriage and no longer live together or fulfill their marital obligations to each other, which constitutes the fact of the breakdown of the marital relationship. Therefore, the plaintiff, Mrs. Wang, is granted a divorce. The judgment has now become effective.
审理后，法院裁定婚姻关系应基于感情，夫妻应在日常生活中相互关心、帮助。共同生活是婚姻生活的重要组成部分，尽管此案中的双方已经结婚多年，但自婚后已分居7年，不再共同生活或履行彼此的婚姻义务，这构成了婚姻关系破裂的事实。因此，原告王女士被准予离婚。该判决现已生效。
The judge explained that in divorce cases, the court makes a distinction between granting and denying a divorce based on whether the marital relationship has truly broken down. In some foreign-related divorce cases, where the parties are abroad and cannot be found, the court should return to the essence of the marital relationship when hearing such cases and examine whether the two parties have lived together based on emotions. If one party can fully prove that the two parties have been separated from each other for a long time after marriage without any communication, economic exchange or other signs of living together, they should be considered to have met the requirements for divorce.
法官解释说，在离婚案件中，法院根据婚姻关系是否真正破裂来区分批准和不批准离婚。在一些涉外离婚案件中，当事人身在国外且无法找到时，法院应当回归婚姻关系的本质，审视双方是否基于感情共同生活。如果一方能充分证明双方婚后长期分居，没有任何沟通、经济往来或其他共同生活的迹象，应被认为已满足离婚的条件。
This handling method can enable the plaintiff to divorce smoothly even if the defendant does not actively resolve the issue or deliberately delays the dissolution of the marital status, preventing the defendant's negative handling from affecting normal life and getting rid of the shackles of "zombie marriage".
这种处理方式可以使原告即使在被告不积极解决问题或者故意拖延解除婚姻状态的情况下，也能顺利离婚，避免被告的消极处理影响正常生活，摆脱“僵尸婚姻”的束缚。
