有关外国人出入境的法律规定
I. Article29 of the Exit and Entry Administration Law of the People'sRepublic of China
I.《中华人民共和国出入境管理法》第二十九条
Wherethe duration of stay specified in a visa held by a foreigner does notexceed 180 days, the holder may stay in China within the durationspecified therein.
外国人持有的签证注明停留期限不超过180天的，持证人凭签证并按照签证注明的停留期限在中国境内停留。
Wherethe duration of stay needs to be extended, the visa holder shall filean application with the exit/entry administration of the publicsecurity organ under the local people's government at or above thecounty level in the place of his stay seven days prior to the expiryof the duration specified in the visa and shall submit relevantmaterials about the specific application matters in accordancewith relevant requirements. If, upon examination, the reasons forextension are appropriate and sufficient, the extension shall begranted; if an extension is denied, the foreigner will be required toleave China on the expiry of the duration.
需要延长居留期限的，签证持有人应当在签证规定的居留期限届满前七日，向县级以上地方人民政府公安机关出入境管理部门提出申请，并按照要求提交具体申请事项的有关材料。经审查，延期理由适当、充分的，准予延期；拒绝延期的，外国人期满出境。
Theaccumulated length of extension shall not exceed the originalduration of stay specified in the visa.
累计延期期限不得超过签证中规定的原停留期限。
II. Article 30of the Exit and Entry Administration Law of the People'sRepublic of China
II. 《中华人民共和国出入境管理法》第三十条
Wherevisas held by foreigners specify that foreigners need to apply forresidence permits after entry, such foreigners shall, within 30 daysfrom the date of their entry, file applications with theexit/entry administration of the public security organ under thelocal people's government at or above the county level in theproposed places of residence for foreigners' residence permits.
外国人持有的签证规定外国人入境后需要申请居住证的，应当自入境之日起30日内向县级以上地方人民政府公安机关申请外国人居住证。
III. Article32 of the Exit and Entry Administration Law of the People'sRepublic of China
III. 《中华人民共和国出境入境管理法》第三十二条
Foreignersresiding in China who apply for the extension of the duration ofresidence shall, within 30 days prior to the expiry of the validityperiod on their residence permits, file applications with theexit/entry administration of the public security organ under thelocal people's government at or above the county level, and submitrelevant materials about the specific application matters inaccordance with relevant requirements. If, upon examination, thereasons for extension are appropriate and sufficient, an extensionshall be granted; if an extension is denied, the foreigner concernedshall leave China on the expiry of the validity period specifiedin their residence permits.
在中国居住的外国人申请延长居留期限，应当在居留许可有效期期满前30日内，向县级以上地方人民政府公安机关出入境管理机关提出申请，并按照有关要求提交具体申请事项的有关材料。经审查，延期理由适当、充分的，准予延期；不予延期的，外国人应当在居留许可规定的有效期期满后出境。
IV. Article36 of the Exit and Entry Administration Law of the People'sRepublic of China
IV. 《中华人民共和国出入境管理法》第三十六条
Decisionsmade by the exit/entry administration of the public security organon rejecting applications for visa extension or reissuance,or on not issuing foreigners' stay or residencepermits or not extending the duration of residence shallbe final.
公安机关出入境机关驳回延期签证、补发申请、不签发外国人居留证、居住证、不延长居留期限的决定，为最终决定。
V. Article 13 ofthe Regulations of the People's Republic of China onAdministration of the Entry and Exit of Foreigners
V.《中华人民共和国外国人入境出境管理条例》第十三条
Duringthe period of time when the applicant's passport or otherinternational travel documents are retained for processing his or herapplication for a visa or permit, the applicant may stay in Chinalegally on the strength of the receipt of acceptance.
在申请人的护照或其他国际旅行证件被扣留以处理其签证或许可证申请期间，申请人可凭受理回执在中国合法停留。
VI. Article20 of the Regulations of the People's Republic of China onAdministration of the Entry and Exit of Foreigners
VI. 《中华人民共和国外国人出出境管理条例》第二十条
Theexit/entry administration of the public security organ may verifyapplication purposes through such means as interview, telephoneinquiry, and on-site investigation. The applicant as well as theentity or individual providing invitation letters orcertification documents shall cooperate.
公安机关出入境管理部门可以通过面谈、电话询问、现场调查等方式核实申请目的。申请人以及提供邀请函或证明文件的单位或个人，应当予以配合。
VII. Article22 of the Regulations of the People's Republic of China onAdministration of the Entry and Exit of Foreigners
VII.《中华人民共和国外国人进出境管理条例》第二十二条
Ifa foreigner holding a residence permit for study intends toengage in off-campus work-study or internship, he or she shall, uponthe approval of the school, apply to the exit/entry administration ofthe public security organ to have such information as the locationand duration of the work-study program or internship placementspecified in his or her residence permit.
持有居留证的外国人从事校外学习、实习的，经学校批准，应当向公安机关申请取得居留证规定的地点、期限、实习地点等信息。
Aforeigner holding a residence permit for study shall not engage inany off-campus work-study or internship unless the informationprescribed in the preceding paragraph is specified in his or herresidence permit.
持有学习类居留证件的外国人，应当在居留证件注明的信息内容规定的区域内从事校外勤工助学或者实习活动，该信息内容未注明区域的，不得超出其所在设区的市级行政区域范围。
VIII. Article26 of the Regulations of the People's Republic of China onAdministration of the Entry and Exit of Foreigners
VIII. 《中华人民共和国外国人入境出境管理条例》第二十六条
Upondiscovery of one of the following circumstances, the entity thatemploys a foreigner or admits a foreign student shall, in a timelymanner, report to the exit/entry administration of the publicsecurity organ of the local people's government at or above thecounty level:
雇用外国人或者招收外国学生的单位，发现有下列情形之一的，应当及时向县级以上地方人民政府公安机关出入境管理部门报告：
(1)A foreign employee resigns or changes employment location;
(1)外国员工辞职或者变更工作地点的；
(2)A foreign student admitted has left the school as he or shehas graduated, completed the course(s) or study, drop out or quitschool;
(2)被录取的外国学生已经毕业、结业、学习、退学、退学的；
(3)A foreign employee or a foreign student admitted violates theprovisions on administration of exit and entry;
(3)被录取的外国雇员或者外国学生违反出境、入境管理规定的；
(4)A foreign employee or a foreign student admitted dies,disappears or other serious circumstances arise.
(4)外国雇员、外国学生被承认死亡、失踪或者出现其他严重情况的。
IX. Foreignersapplying for changes in their residence permit registration and birthregistration in Beijing shall comply with the following legalprovisions.
IX. 外国人在北京申请变更居留许可登记和出生登记的，应当符合下列法律规定。
Article33 of the Exit and Entry Administration Law of the People'sRepublic of China:
《中华人民共和国出境入境管理法》第三十三条：
Theregistered items of a foreign residence permit shall includename, sex, date of birth, reason for residence and duration ofresidence of the holder, date and place of issuance, the number ofpassport or other international travel document. Where theregistered item in a foreigner's residence permit has changed, theholder shall, within 10 days from the date of change, apply to theexit/entry administration of the public security organ under thelocal people's government at or above the county level in the placeof residence for going through the formalities for alteration.
外国居留证的登记项目应当包括姓名、性别、出生日期、居留理由和居留时间、签发日期和地点、护照或其他国际旅行证件的编号。外国人居留证登记事项发生变更的，持票人应当自变更之日起十日内向居住地县级以上地方人民政府公安机关出入境管理部门申请办理变更手续。
Article40-1 of the Exit and Entry Administration Law of thePeople's Republic of China:
《中华人民共和国出入境管理法》第四十条第一条：
Forforeign infants born in China, their parents or agents shall, within60 days after they are born, based on the strength of the birthcertificates, go through the formalities for stay or residenceregistration for them with the exit/entry administration of thepublic security organ under the people's government at or above thecounty level in the places of their parents' stay or residence.
在中国出生的外国婴儿，其父母、代理人应当在出生后60日内，根据出生证明，向其父母居住地所在地的县级以上人民政府出入境管理部门办理居留、居留登记手续。
